The short answer

If your online store is based in Florida, you charge Florida sales tax on taxable items you deliver to customers in Florida: the 6% state rate plus the discretionary sales surtax of the county where the order is delivered. If you sell into Florida from another state, you must register and collect once your taxable remote sales into Florida exceed $100,000 in the previous calendar year. There is no transaction-count test.

This is general information as of 2026, not tax or legal advice. Rules on specific products, shipping charges and exemptions vary, so confirm your situation with the Florida Department of Revenue or a CPA.

Florida-based stores: what to charge

For a store with a physical presence in Florida, any taxable sale delivered to a Florida address is subject to Florida tax. Three rules do most of the work:

  • State rate. The general Florida sales tax rate is 6%.
  • County surtax follows the delivery address. The Department says surtax is collected at the rate of the county where delivery is made. An order shipped from Fort Lauderdale to a customer in another county uses that county’s surtax, not Broward’s. If the destination county has no surtax, none is due.
  • Surtax has a $5,000 cap. Discretionary sales surtax applies only to the first $5,000 of the sales amount on a single item of tangible personal property. The 6% state rate applies to the full price.

County rates change. For 2026, the Department’s DR-15DSS form lists the current surtax rates and the changes that took effect on January 1, 2026, including a new surtax, an expired surtax and an extended surtax in a few counties. The Department updates the form each November, so a rate table hard-coded into your store will go out of date.

Orders shipped outside Florida

When a Florida store ships to a customer in another state, Florida sales tax generally does not apply to that sale. That does not mean the sale is tax-free. Once your sales into another state pass that state’s economic nexus threshold, you may have to register and collect there too. Most states use $100,000 in annual sales, but several use different amounts or measurement periods. Track your sales by destination state every month so you know when you are getting close.

Remote sellers selling into Florida

Florida adopted economic nexus with a law that took effect on July 1, 2021. As of 2026, the Department’s guidance says:

  • An out-of-state retailer with no physical presence in Florida must collect Florida sales tax once its taxable remote sales into Florida exceed $100,000 in the previous calendar year.
  • The count is based on the previous calendar year only, and it is a dollar test. Florida does not use a 200-transaction rule.
  • Remote sellers collect the discretionary sales surtax of the county where the item is delivered, the same as Florida-based dealers.
  • Sales made through a marketplace provider that collects the tax on your behalf are excluded from your own returns.

Marketplaces: Amazon, Etsy, eBay and others

Florida treats large marketplaces as the party responsible for the tax. A marketplace provider must register and collect if it has a physical presence in Florida or facilitated more than $100,000 of taxable remote Florida sales in the previous calendar year. When the provider collects tax on your marketplace orders, you may not collect it again, and you exclude those sales from your own return.

The practical result for a seller with both a website and a marketplace shop: the marketplace handles tax on marketplace orders, and you handle tax on website orders. Keep the two sales channels separate in your books so your return matches what you collected.

Registering, filing and paying

  1. Register before you collect. Use the Florida Business Tax Application on the Department’s site. You should not charge Florida tax without a certificate of registration.
  2. Know your filing frequency. Sales and use tax is reported on Form DR-15. The Department sets frequency by how much tax you collect each year: monthly above $1,000, quarterly from $501 to $1,000, semiannually from $101 to $500 and annually at $100 or less. Most new businesses start quarterly.
  3. File every period, even with zero sales. Returns are due on the 1st and late after the 20th of the month after each reporting period.
  4. File and pay electronically on time. Doing so earns a collection allowance of 2.5% of the first $1,200 of tax due, capped at $30, according to the Department.
  5. Use your Annual Resale Certificate. Registered dealers receive one each year so they can buy inventory for resale without paying tax. Certificates expire on December 31.

How online stores handle Florida sales tax

Charging the right surtax by county is the part most stores get wrong. A flat 6% setting, or a single rate for your own county, undercharges or overcharges customers elsewhere in the state. ZIP codes do not always line up with county lines, so address-based lookup is more reliable than a ZIP table.

  • Shopify. Shopify has a built-in tax service, Shopify Tax, for US merchants. Enter your Florida registration in the tax settings so Shopify knows to collect, then place test orders to addresses in two or three counties and check the surtax charged.
  • WooCommerce. The built-in tax tables are manual. Most Florida stores use an automated tax extension or service so rates update without anyone editing tables.
  • Dedicated tax software. Services such as Avalara, TaxJar or similar tools calculate rates at checkout, track sales by state and can prepare or file returns. They are worth considering once you sell into several states.

Whatever you use, set up a monthly check: compare tax collected by county in your store reports with what goes on your DR-15. If they differ, find out why before you file.

Setup checklist for a Florida online store

  • Registration certificate in hand before the first taxable sale.
  • Store tax settings switched on for Florida, with rates based on the full delivery address.
  • Product tax categories reviewed. Some items, such as many groceries and certain medical supplies, are treated differently; confirm with your accountant.
  • Exempt customers handled: resale and exemption certificates collected and the customer accounts marked tax-exempt.
  • Shipping charges reviewed with your accountant, because how they are billed affects whether they are taxable.
  • Marketplace sales kept apart from website sales in your accounting.
  • A monthly report of sales by destination state, to watch other states’ thresholds.
  • A calendar reminder for every filing due date, including zero-sales periods.
