If your online store is based in Florida, you charge Florida sales tax on taxable items you deliver to customers in Florida: the 6% state rate plus the discretionary sales surtax of the county where the order is delivered. If you sell into Florida from another state, you must register and collect once your taxable remote sales into Florida exceed $100,000 in the previous calendar year. There is no transaction-count test.
This is general information as of 2026, not tax or legal advice. Rules on specific products, shipping charges and exemptions vary, so confirm your situation with the Florida Department of Revenue or a CPA.
For a store with a physical presence in Florida, any taxable sale delivered to a Florida address is subject to Florida tax. Three rules do most of the work:
County rates change. For 2026, the Department’s DR-15DSS form lists the current surtax rates and the changes that took effect on January 1, 2026, including a new surtax, an expired surtax and an extended surtax in a few counties. The Department updates the form each November, so a rate table hard-coded into your store will go out of date.
When a Florida store ships to a customer in another state, Florida sales tax generally does not apply to that sale. That does not mean the sale is tax-free. Once your sales into another state pass that state’s economic nexus threshold, you may have to register and collect there too. Most states use $100,000 in annual sales, but several use different amounts or measurement periods. Track your sales by destination state every month so you know when you are getting close.
Florida adopted economic nexus with a law that took effect on July 1, 2021. As of 2026, the Department’s guidance says:
Florida treats large marketplaces as the party responsible for the tax. A marketplace provider must register and collect if it has a physical presence in Florida or facilitated more than $100,000 of taxable remote Florida sales in the previous calendar year. When the provider collects tax on your marketplace orders, you may not collect it again, and you exclude those sales from your own return.
The practical result for a seller with both a website and a marketplace shop: the marketplace handles tax on marketplace orders, and you handle tax on website orders. Keep the two sales channels separate in your books so your return matches what you collected.

Charging the right surtax by county is the part most stores get wrong. A flat 6% setting, or a single rate for your own county, undercharges or overcharges customers elsewhere in the state. ZIP codes do not always line up with county lines, so address-based lookup is more reliable than a ZIP table.
Whatever you use, set up a monthly check: compare tax collected by county in your store reports with what goes on your DR-15. If they differ, find out why before you file.

If you have a Florida presence, you charge Florida tax on taxable items delivered to Florida addresses: 6% plus the surtax of the delivery county. Orders shipped out of state are generally not subject to Florida tax. This is general information; confirm with your CPA.

The surtax of the county where the order is delivered. If that county has no surtax, none is charged. Surtax applies only to the first $5,000 of a single item’s price.
Generally no. Marketplace providers that meet Florida’s rules collect and remit tax on marketplace orders, and you exclude those sales from your own return. You still handle tax on sales through your own website.
It depends on how much tax you collect: monthly above $1,000 a year, quarterly from $501 to $1,000, semiannually from $101 to $500 and annually at $100 or less. Returns are due on the 1st and late after the 20th.
